The lawsuit about the Battle Angel trademark that Epic Stone Group filed against Twentieth Century Fox Corporation has been voluntarily dismissed, and the case is closed.

This happened after the court notified ESG that the case would be automatically dismissed, unless ESG were able to serve the lawsuit on Fox within May 30th, or adequately explain why they had failed to do so. The Federal Rules of Civil Procedure mandate this after a set number of days to get rid of lawsuits which have gone stale or haven't been properly served.

This automatic dismissal would have been "without prejudice", which is a legal term that means the lawsuit can be re-filed if they want to. What happend instead was this: When ESG's lawyer got the notice about the pending automatic dismissal, that lawyer rather filed a notice for voluntary dismissal "with prejudice" - meaning that ESG can't file an identical or substantially similar lawsuit against Fox again.
